Glossary term: Formal equality
Formal equality is treating everyone in similar circumstances the same. Formal equality does not consider social and historical context, or different needs and circumstances of different people or groups. It does not recognize that sometimes in order for the impact of a law or policy to be fair, we need to treat people differently.
