Glossary term: Substantive equality


Substantive equality looks at the impact of a law or policy to see whether the outcome is equal for different groups of people. Substantive equality considers social and historical context. It recognizes that sometimes in order for an outcome to be fair, laws or policies may need to treat people differently depending on their needs and circumstances. Substantive equality is different than formal equality.
