You run a local comedy club and you often have your staff emcee comedy shows. One evening, your employee is emceeing the comedy show when he notices a woman in the audience kiss her girlfriend. He starts to make homophobic comments about the couple from the stage. These comments include slurs and sexual comments about lesbians. The woman and her friends at the table boo the emcee and one says that he is being ‘ignorant.’ Once offstage, your employee approaches the couple’s table and continues to make homophobic and sexual comments about the couple. The women tell your employee to stop bothering them and not to come near their table again. They are visibly upset and one of the women heads to the bathroom crying. On her way back to the table, your employee blocks her path and continues his tirade of homophobic and sexual comments. He says she has ruined the show, grabs her sunglasses from the top of her head and breaks them.

You arrive at the club after this incident has occurred, and your employee tells you that the two women are drunk and ruined the show. You employee does not mention what he said to the women. When the women return to the club to complain the next day, you apologize and offer to pay for the broken sunglasses, but you also tell them that they had been disruptive and were also responsible for what had happened.

With his homophobic verbal attack on your customers, the emcee violated the Code and caused harm to your health and wellbeing. As the comedy club owner, you have a responsibility to make sure that your services are provided in ways that are not discriminatory. You failed to do this when your employee discriminated against the couple based on their sex as women and their sexual orientation as lesbians.
